Welcome to Destination Auto Parts. These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“the Customer,” “you,” or “your”) and Marlis Dynamics LTD., an Alberta corporation doing business as Destination Auto Parts (“the Company,” “we,” or “our”).
By accessing our website or purchasing any products from us, you agree to be bound by these Terms.
LEGAL IDENTITY
Destination Auto Parts is a registered trade name of Marlis Dynamics LTD. All contractual obligations, rights, and liabilities associated with Destination Auto Parts belong solely to Marlis Dynamics LTD.
PRODUCT USE AND FITMENT DISCLAIMER (IMPORTANT)
Customer Responsibility: It is your sole responsibility to verify that the parts you are purchasing are compatible with your specific vehicle’s year, make, model, and trim. We do not guarantee fitment based on third-party supplier descriptions.
Off-Road and Show Use Only: Many aftermarket products sold by Destination Auto Parts are designed exclusively for off-road, track, or show use. It is your responsibility to check your local, provincial, and state laws regarding the legality of installing and operating these parts on public roads.
Installation Liability: We strongly recommend professional installation for all automotive parts. Marlis Dynamics LTD. is not liable for any vehicle damage, mechanical failure, personal injury, or legal penalties resulting from improper installation, use or modification of any product.
ORDERS, PRICING, AND FULFILLMENT
Sourcing and Fulfillment: To provide a wide selection of specialized components, we utilize a multi-channel fulfillment model. This means that while certain products are shipped directly from our primary facilities, others are drop-shipped directly from the manufacturer or an authorized third-party distributor.
Inventory & Availability: Regardless of the fulfillment method, all orders are strictly subject to availability. While we strive for accuracy, stock levels–particularly for drop-shipped items–are managed by third parties and are subject to change without notice.
Right to Cancel: If a purchased item is discontinued, backordered, or otherwise unavailable from our internal inventory or our network of suppliers, we reserve the right to cancel your order and issue a full refund immediately.
MAP Price: Certain manufacturers and suppliers require a Minimum Advertised Pricing Policy. This prevents products from being priced lower than what is currently listed for on the website. Selling products lower than the MAP will result in the forfeit of warranty.
Special Orders: Special Orders are determined on a case-by-case basis. We will contact you directly prior to processing your order.
SHIPPING, CUSTOMS, AND INTERNATIONAL ORDERS (USA)
Free Shipping Promotions: Certain product or order totals may qualify for free shipping. Free shipping offers apply only to standard shipping methods and may be subject to geographic exclusion (such as international orders or remote areas) as noted at the time of checkout.
Split Shipments: Because we fulfill orders from multiple locations and suppliers, your order may arrive in multiple packages. Each package may have a unique tracking number. You will not be charged additional shipping fees for split shipments unless explicitly stated at the time of purchase.
Risk of Loss: Title and risk of loss for all physical goods pass to you upon our delivery of the items to the shipping carrier. We are not responsible for packages lost, stolen, or damaged in transit.
Cross-Border Sales (USA): For orders shipped to the United States, you (the Customer) are designated as the Importer of Record. You are solely responsible for paying any applicable import duties, customs fees, state sales taxes, or brokerage fees upon delivery. Marlis Dynamics LTD. is not liable for delays caused by US Customs and Border Protection, nor will we issue refunds for packages abandoned due to unpaid customs fees.
Insurance: All products shipped from the Company may or may not be insured by our suppliers, but if insured, it is at no additional cost to you.
PO Box: Most of our products cannot be shipped to a P.O Box. Each order will be dealt with on a case-by-case basis. If The Customer only has a P.O Box address, there are solutions such as shipping to an alternative address. Please email us for more information as each situation varies.
MISSING PACKAGES (“PORCH PIRATE” CLAUSE)
Carrier Authority: If a shipping carrier’s tracking information indicates that a package has been “Delivered,” this shall serve as conclusive proof of delivery. Marlis Dynamics LTD. is not responsible for packages that are stolen, misplaced, or missing following a confirmed delivery by the carrier.
Customer Responsibility for Security: It is the Customer’s sole responsibility to provide a secure delivery location. We strongly recommend tracking your shipment closely and ensuring someone is available to receive the package, especially for high-value automotive components.
The “Porch Pirate” Rule: We do not issue refunds or ship free replacements for items that are marked as “Delivered” but are claimed to be missing or stolen.
Required Protocol for Missing Items: If your tracking says “Delivered” but you cannot locate the package, you must:
- Verify the delivery address on your order confirmation.
- Check with neighbors or building management.
- Contact the carrier immediately to check for “GPS delivery coordinates.”
- In cases of suspected theft, file a report with your local police department.
RETURNS AND REFUNDS
Return Window: Returns are accepted within 30 days of delivery. “Receipt of Delivery” is determined based on the shipping carrier (see section below).
Mandatory RMA Process: You must not ship any items back without a Return Merchandise Authorization (RMA) number. To request an RMA, contact our support team with your order number and the reason for the return. Items returned without an RMA number will be refused at the warehouse to the sender at the sender’s expense.
Restocking Fees: While we strive to keep costs low, please note that certain products are subject to a restocking fee based on the supplier’s policy, which will be deducted from your total refund amount.
Conditions of Goods: To be eligible for a return, parts must be strictly uninstalled, unattempted to be installed, in their original packaging (including paperwork) and in brand-new resealable condition.
Non-Returnable Items: To maintain the safety and quality of our inventory, the following items are strictly non-returnable:
- Installed Items: Any part that shows signs of being bolted on, plugged in, or otherwise installed.
- Custom/Special Orders: Parts that were custom-painted, fabricated, or special-ordered specifically for your vehicle.
- Open Software: Any digital tuners or software packages where the seal has been broken.
Return Shipping Labels: The Customer is strictly responsible for purchasing the return shipping label and covering all return shipping costs. We highly recommend using a trackable shipping service and purchasing shipping insurance as we cannot guarantee receipt of your returned item. Return shipping costs are non-refundable unless the return is a direct result of our error (e.g., shipping the wrong SKU). If product is returned not in the appropriate condition, The Customer may be subject to a partial refund or not at all.
Original Shipping Costs: Please note that original shipping costs paid at the time of purchase (including “Free Shipping” costs incurred by the Company) are non-refundable and will be deducted from the final refund amount.
DAMAGED, DEFECTIVE, OR INCORRECT PRODUCTS
Definition of Delivery Receipt: For the purposes of this agreement, “Receipt of Delivery” is defined as the moment the shipping carrier (UPS, Canada Post, FedEx, etc.) updates the tracking status to “Delivered.” This timestamp serves as the official start of the inspection window, regardless of whether a physical signature was obtained or if the customer was present at the time of drop-off.
72-hour Inspection Window: Any claims for products that are damaged in transit, manufacturer-defective, or incorrectly shipped must be reported to Destination Auto Parts within 72 hours of Receipt of Delivery.
The “Absence” Rules: Claims made after this 72-hour window will not be honored. The customer’s absence from the delivery address or failure to open the package promptly does not extend this reporting period.
Proof of Delivery: In the event of a dispute regarding the delivery time, the records provided by the third-party shipping carrier shall be considered the final and governing authority.
Required Documentation: To process a claim, you must provide the following to our support team:
- Clear photos of the outer shipping box (including the shipping label).
- Clear photos of the specific damage, defect, or the incorrect part received.
- A brief description of the issue and your order number. Note: DO NOT discard any packaging materials until the claim is officially resolved.
Resolution Process:
- Incorrect/Damaged Items: If we verify that an item was shipped incorrectly or arrived damaged, we will–at our discretion–provide a replacement or a full refund. In these specific cases, Marlis Dynamics LTD. will provide a pre-paid return shipping label.
- Defective Items: Products that appear to have a manufacturing defect are subject to the Manufacturer’s Warranty (see section below). We will assist you in the warranty claim process, but the final determination of “defective” status rests solely with the manufacturer.
Limitations and Installation: We are not responsible for damage caused by improper handling, attempted installation, or modification of the product. If a part has been installed or modified in any way, a claim for “incorrect” or “damaged” status will be automatically denied. We strongly advise dry-fitting all parts for compatibility before beginning any installation.
WARRANTIES
Manufacturer Warranty Only: Marlis Dynamics LTD. does not offer any independent warranties for any products sold. All warranties are strictly limited to those provided by the original manufacturer. We will assist in facilitating warranty claims with the manufacturer where possible, but we are not responsible for the outcome of those claims.
INTELLECTUAL PROPERTY
All content on the Destination Auto Parts website, including text, graphics, logos, and images, is the intellectual property of Marlis Dynamics LTD. or used under license from our suppliers. Unauthorized use, copying, or reproduction of this material is strictly prohibited.
LIMITATION OF LIABILITY
To the maximum extent permitted by Alberta law, Marlis Dynamics LTD., its directors, officers, and affiliates shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from the purchase, installation, or use of any product. In no event shall our total liability to you exceed the total amount paid by you for the specific product in dispute.
GOVERNING LAW AND DISPUTE RESOLUTION
These Terms, and any dispute arising from the purchase of goods from Destination Auto Parts, shall be governed by the laws of the Province of Alberta and the federal laws of Canada, without regard to conflict of law principles. Any legal proceedings shall be brought exclusively in the courts located in Edmonton, Alberta.
